Terms of Service
These Terms of Service govern use of the MIassist mobile inspection application operated by Jonathan Walling, doing business as MIassist. By downloading or using the App, you agree to be bound by these Terms.
1. Use of the App
MIassist functions as a professional mobile inspection tool for qualified field inspectors. Users must be at least 18 years old and agree to use the application only for lawful purposes consistent with these Terms.
2. Account Registration
Accessing certain App features requires account creation. Users bear responsibility for protecting login credentials and all account activity. Any unauthorized access should be reported immediately to support@miassist.co.
3. Inspection Data and Content
Users retain ownership of inspection data, reports, photos, and other materials created through the App. Users alone are accountable for the accuracy, completeness, and legality of their content. The company does not review, verify, or endorse inspection findings or reports.
4. Professional Responsibility
The App assists professional inspectors but does not substitute for professional judgment, certifications, or qualifications required under applicable codes and standards, including API 510, API 570, API 653, and STI SP001. Users must ensure inspections comply with applicable regulations and their professional qualifications.
5. Subscription and Payment
Paid subscription features are processed through Apple App Store or Google Play Store. Subscription fees are charged in advance and are non-refundable except as required by law or app store policies.
6. Intellectual Property
The App, including design, features, and underlying technology, belongs to Jonathan Walling / MIassist and is protected by intellectual property laws. Users may not copy, modify, distribute, or reverse engineer any App component.
7. Privacy
App use is governed by the Privacy Policy, incorporated by reference into these Terms.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. The company does not warrant uninterrupted, error-free, or virus-free operation.
9. Limitation of Liability
To the maximum extent permitted by law, Jonathan Walling / MIassist is not liable for indirect, incidental, special, consequential, or punitive damages from App use. Total liability is limited to amounts paid for the App in the preceding twelve months.
10. Indemnification
Users agree to indemnify and protect Jonathan Walling / MIassist from claims, damages, losses, or expenses, including attorney fees, arising from App use, Terms violations, or third-party rights violations.
11. Termination
The company reserves the right to suspend or terminate accounts for Terms violations. Users may delete accounts by contacting support@miassist.co.
12. Changes to These Terms
Terms may be updated periodically. Material changes are indicated by updating the date at the top of this document. Continued App use after updates constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by Delaware law, without regard to conflict of law provisions.
